INTRODUCTION

Government Regulation (PP) Number 22 Year 2011 was ratified by the government on April 4, right the on schedule agreed upon by the House of Representatives' Commission V and the Ministry of Energy and Mineral Resources and Ministry of Transportation at a hearing held on March 11,2011. The government regulation comes a result of the compromise struck by the House and the government to avoid a deadlock related to the application of cabotage principle as governed in Shipping Law Number 17 Year 2008. The provision in Law Number 17 requires all ships operating in Indonesian waters, including ships serving offshore oil and gas activities to carry Indonesian flags and operated by Indonesian citizens.

This government regulation provides exception or dispensation for foreign ships from the cabotage principle to participate in activities offshore Indonesia. The issuance of the regulation is expected to enable Indonesia to come out of the dilemmatic situation caused by the legislative demands and the demands from business communities venturing in Indonesia's offshore oil and gas sector.

However, optimism resulting from the issuance of the government regulation still leaves various questions for parties, mainly offshore oil and gas business communities, both production sharing contractors (KKKS) and ship operators. The questions are, among others, Who is the party assigned to verify the availability of ships in the country? What is the kind of dispensation which can be obtained by foreign ships supporting Indonesia's offshore oil and gas operations? Must the foreign ships change their flags into Indonesian ones or not? Does PP No. 22 not contravene Law Number 17, which is higher hierarchically than the said PP? These all need deeper elaboration so that business communities, either KKKS and ship owners obtain clear information.

Department of Transportation has just issued a Regulation of the Minister of Transportation (Permenhub) No PM 48/2011 on Procedures and Requirements for Granting Permission To Use Foreign Ship for Activities Excluding Transporting Passengers or Goods in domestic sea freight. The ministerial regulation also provide detailed rules on the length of time of the use of foreign vessels by type of activity and type of vessel.

Pendahuluan

Peraturan Pemerintah (PP) No. 22 tahun 2011 telah disahkan pemerintah tanggal 4 April lalu, sesuai dengan jadwal yang disepakati Komisi V DPR RI dengan Departemen Energi dan Sumber Daya Mineral dan Departemen Perhubungan pada Rapat Dengar Pendapat tanggal 10 Maret 2011. PP ini merupakan jalan tengah yang ditempuh oleh DPR dan Pemerintah untuk keluar dari kebuntuan ketentuan azas cabotage sebagaimana diatur dalam Undang-Undang Pelayaran No. 17 thn 2008. Ketentuan dalam UU No. 17 mewajibkan semua kapal yang beroperasi di perairan Indonesia, termasuk di kegiatan offshore migas, berbendera Indonesia dan diawaki oleh warga negara Indonesia.

PP No. 22 thn 2011 ini memberi dispensasi kepada kapal asing dari azas cabotage untuk ikut terlibat dalam aktivitas lepas pantai perairan Indonesia. Dengan keluarnya PP ini diharapkan Indonesia bisa keluar dari situasi dilematis antara tuntutan perundang-undangan dengan tuntutan bisnis para pelaku usaha sektor offshore migas Indonesia.

Optimisme dari keluarnya PP ini masih menyisakan berbagai pertanyaan dari banyak pihak, terutama para pelaku bisnis offshore migas, baik para KKKS maupun para pengusaha kapal. Beberapa pertanyaan itu antara lain: siapa atau badan apa yang memferifikasi tentang ketersediaan kapal di dalam negeri? Dispensasi seperti apa yang bisa didapatkan oleh kapal asing penunjang operasi offshore migas Indonesia? Apakah kapal asing dimaksud harus berubah berbendera Indonesia atau tidak?. Lalu apakah PP No. 22 ini tidak bertentangan dengan UU No. 17 yang dari segi struktur perundang-undangan lebih tinggi dari PP? Semua hal di atas perlu dielaborasi lebih dalam sehingga para pelaku bisnis baik KKKS maupun para pemilik kapal memperoleh informasi yang jelas.

Departemen Perhubungan baru saja menerbitkan Peraturan Menteri Perhubungan (Permenhub) No PM 48/2011 tentang Tata Cara dan Persyaratan Pemberian Izin Penggunaan Kapal Asing Untuk Kegiatan Lain Yang Tidak Termasuk Kegiatan Mengangkut Penumpang atau Barang Dalam Kegiatan Angkutan Laut Dalam Negeri. Permenhub ini juga secara rinci juga mengatur jangka waktu penggunaan kapal asing berdasarkan jenis kegiatan dan jenis kapal.

GOAL & OBJECTIVE

The workshop is intended to socialize regulation regarding forest area leasehold to all related stakeholders so that the event is expected to enable the whole prospective users of forest area to understand in a detailed manner and comprehensively various reliefs and the licensing procedures in the revision of license to leasehold forest are. Hopefully, the revision further facilitates and provides better legal certainty for forest area users.

The comprehensive, detailed and technical explanation about the issuance of license to leasehold forest area will be provided by a planology team of the Forestry Ministry through interactive and technical discussions of examples of related cases under guidance of resource persons handling the forest area leasehold licensing in their daily activities. The explanation will facilitate forest area users to submit and secure license to leasehold forest area appropriately and quickly.
