Bahtera Adhiguna: PQ Invitation for coal shipping joint operation services

INVITATION TO PRE-QUALIFY FOR TENDER PROCESS
COAL SHIPPING JOINT OPERATION SERVICES

PT Bahtera Adhiguna (Persero) (?BAg?), the state-owned shipping company and currently in the legal process to become the subsidiary of PT Perusahaan Listrik Negara (Persero), intends to select a potential partner for joint operation of approximately four (4) millions coal transportation per annum from Indonesian coat mines to Central Java, and therefore, invites parties to register (each an ?Applicant) to participate in the Pre-qualification Process for Coal Shipping Joint Operation Services. Participation in the Bidding Process shall be limited only to those Applicants who have been qualified in the Prequalification Process.

The selected partner (?Coal Shipping Joint Operation Company?) will be required to transport approximately four (4) millions tons coal per annum to Central Java from several loading ports of Indonesian coal mines, based on the planning and instruction provided by BAg, including, but not limited to, (a) arrangement of the vessels, (b) operation and maintenance of the vessels, (c) management of the staff and vessels? crew, and (d) any other shipping related matters to be specified in the terms and conditions in the Request for Proposal (RFP) documents, for the duration of approximately ten (10) years or more of the term of the service agreement (?Coal Shipping Joint Operation Agreement?). To participate in the Tender, The Applicant shall be an Indonesian-registered shipping company (having valid SIUPAL) or foreign registered shipping company and must fulfill the following minimum basic criteria (the ?Basic Criteria?) directly or indirectly through a subsidiary or affiliate company:

A. The Applicant including its potential partnership member(s) by themselves or through the Affiliates is, as of the date of this invitation, a ship-owner of at least:
(i) two (2) single deck bulk carrier vessels, at or more than 65,000DWT or,
(ii) three (3) HANDYMAX class vessels (at or more than 43,0000WT) or,
(iii) one (1) PANAMAX class vessel and two (2) HANDYMAX class vessels, where the ?ship-owner? will either be the outright owner of the vessels, or have a valid long-term lease, in excess of seven (7) year term, for the sole right of use of the vessels, used as a reference for this criterion, and shall preferably have a valid ISO 9001:2000 certification in respect of shipping services

B. The Applicant including its potential partnership member(s) by themselves or through the Affiliates has at least one (1) contract executed within the last five (5) years prior to the date of this Invitation representing an annual carriage of at least one (1) million tons of dry bulk commodities.

C. The Applicant including its potential partnership member(s) by themselves or through the Affiliates has more than one (1) year experience within the last five (5) years prior to the date of this Invitation, as a carrier of coal (as principal service-provider, and not as agent or broker).

All interested parties may purchase the Pre-qualification Document from BAg, at the following address between 09.00-15.00 from May 18 to 24, 2010, upon cash payment of a non-refundable fee of five hundred thousand rupiahs (Rp 500,000).

The sealed Pre-qualification Application must be delivered by hand or by prepaid, registered, or certified mail or by courier to the above address not later than 14:00 on June 03, 2010. Any Pre-qualification Application received by BAg alter 14:00 on June 03,2010 will be rejected outright, regardless of what the reason for delay may be, and shall be returned to the Applicant unopened.

BAg shall have the right, without further notice or justification of their actions, to disqualify any Applicant being failed to comply fully with the requirements set out in this Pre-qualification Document.
