Bentala demands BII to pay Rp 1 trillion in compensation

PT Bentala Coal Mining has filed a legal suit at the Central Jakarta district court against Bank International Indonesia (BII) for the loss it suffered due to the legal action recently taken by the bank against the coal mining company last year.
In its legal suit, the company demanded a compensation payment of a total of Rp 1 trillion from the bank due to the material and immaterial losses it suffered due to the bankruptcy petition filed by the bank.
The company's lawyer said that the bankruptcy petition filed by the bank in the Jakarta commercial court recently had caused a loss to the company to about Rp 977.04 billion and US$50,000 due the delay in investment, the fall in sales and the cost of the company in coping with the suit.
The bank filed recently a bankruptcy petition against guarantors of the coal mining company's debts to a syndicate of banks comprising of BII and other six local banks. The court rejected the bankruptcy petition due to lack of proofs. The bank then rejected the court decision and appealed to the Supreme Court. But its appeal was rejected. (*)
