C. Kalimantan Provincial Government: PQ invitation for Puruk Cahu-Bangkuang coal railway project

THE PURUK CAHU - BANGKUANG RAILWAY PROJECT NOTICE OF REQUEST FOR PREQUALIFICATION
1. CENTRAL KALIMANTAN PROVINCIAL GOVERNMENT (THE ?GOVERNMENT?), intends to select a potential project investor (THE ?PROJECT INVESTOR?) to finance, design, construct, operate, and maintain The Puruk Cahu - Bangkuang Railway Project in Central Kalimantan Province (THE ?PROJECT?), through a competitive selection process;
2. THE PROJECT INVESTOR selection will be implemented under Presidential Regulation (PERPRES) 13/2010, a legal framework for public-private partnerships (PPP) in infrastructure projects;
3. THE GOVERNMENT is now offering a Request for Pre-Qualification (?PQ?) to the interested parties as a PROJECT INVESTOR;
4. The selected PROJECT INVESTOR will have to cooperate with regional state owned company (BUMD) through joint venture company to finance, design, construct, operate, and maintain the PROJECT on a Build-Operate-Transfer (BOT) basis; which will be transferred to THE GOVERNMENT at the end of the BOT contract;
5. THE PROJECT will be divided in two phases. Phase 1A consist of Puruk Cahu - Bangkuang by railway and Bangkuang - Batanjung/Lupak Dalam by river way. Phase 1B consist of the construction of railway from Bangkuang to Batanjung/Lupak Dalam based on feasibility study done by PROJECT INVESTOR.
6. THE PROJECT cost estimate for Phase 1A is about US $1.5 Billion, to build railway line approximately 185 Km, river way through the barges approximately 175 Km, and coal terminal port at Batanjung/Lupak Dalam;
7. THE PROJECT INVESTOR has the right to manage and operate transportation from Puruk Cahu to Bangkuang through railway and from Bangkuang to Batanjung/Lupak Dalam Coal Terminal through barges, and to handle coal from coal terminal to mother vessel;
8. THE GOVERNMENT will impose road transportation restrictions which regulated by local regulation (Perda) and also would facilitate the investor to obtain coal concession;
9. THE GOVERNMENT will be responsible for land acquisition and costs related to railway line, Batanjung/Lupak Dalam Coal Terminal and its facilities;
10. The prequalification process is intended to select qualified investor that are eligible to participate in the international competitive bidding to select the PROJECT INVESTOR;
11. THE GOVERNMENT seeks to pre-qualify interested parties who have experiences in implementing the relevant projects;
12. The qualification criteria are based on financial, technical, and legal standing, and are designed to demonstrate a proven track record in financing, designing, constructing, operating, and maintaining large relevant PROJECT;
13. Interested parties should submit a Letter of Interest (LoI) starting from March 26th 2010 up to April 16th 2010, addressed to: Procurement Committee

14. The Pre-Qualification Document will be available and can be collected at the above address, on May 17th 2010 up to June 17th 2010 at 08.00 am - 14.00.00 pm WIB (Western Indonesia Time);
15. Interested parties should submit PQ applications in accordance with the criteria set forth in the Pre-Qualification Document. Only applicants whose Qualification Statements demonstrate that they meet all of the criteria set forth in the Pre-Qualification Document will be invited to submit bids for the Project;
16. THE GOVERNMENT will guarantee to long term transportation agreement with the coal miners to transport the coal through the railway, barges, up to Batanjung/Lupak Dalam. (*)
