for Steaming Coal Supply Contract(for TAEAN Power Plant)

(1) Shipment Size & Delivery Term
- 2 Panamax on either FOBT only or CFR only or both FOBT and CFR.

(2) Coal Mine
Each shipment of coal to be purchased by KOWEPO and delivered by the Bidder shall be entirely supplied from a genuine single mine. Supply of coal for any shipment from more than one mine may not be allowed. KOWEPO, at its sole discretion, appoint and dispatch an independent inspector for the whole unloading process including but not limited to – barge loading, barge transferring, mother vessel loading, measuring temperatures of the barge coal, coal sampling, laboratory witnessing, sample sealing and etc,. Especially the observing test procedure for the determination of quality of coal at laboratory and the access to independent inspection agency facilities shall be guaranteed by the Seller at the loading port.

The Sampling analysis shall be performed on each barge and a vessel, and the Seller shall provide each certificate to KOWEPO. In the event that the quality is outside the limit of range as specified in the attached ITB, the Buyer has the right to reject such inferior coal.

Upon request by KOWEPO, a Bidder shall provide to KOWEPO''s satisfaction relevant supporting documents including certificates issued by the relevant authorities of the exporting country to demonstrate the legal status and current situation of the coal mine from which the coal would be supplied.

3. Document
Bidder shall submit to KOWEPO ?Coal Mine Information Sheet? as attached in the Invitation to Bid not later than seven (7) days before issuing the B/L. If not, KOWEPO has the right to delay the payment. The relevant evidence documents will be in English.

○ Sale and Purchase Agreement between Bidder and Coal miner
○ Mine exploitation License for the proposed coal mine

4. Procurement Method: International Open Bidding

5. Deadline for Bidding: 11:00 July 3, 2012. (Korea Standard Time)

6. Qualification of Bidder
Coal production company or Marketing company or Trading company only those who has performed (without any material problem such as coal quality etc.) any coal supply of no less than 60,000MT(one panamax) to one of the five(5) power generation companies(KOWEPO, KOSEP, KOMIPO, KOSPO, and EWP) or major power generation companies(or electric power companies) in Taiwan, Japan or major steel mill companies in Taiwan, Japan and Korea, who shall meet the whole requirement of ITB including but not limited to coal quality specification, shipping schedule and quality, etc.
