IDX-listed coal mining firm PT Bayan Resources Tbk said that the Samarinda State Administrative Court has accepted a request made by its indirect coal subsidiary PT Orkida Makmur (PTOM) for an ?intervention? in a court dispute between coal firm PT Senyiur Sukses Peratama, as the plaintiff, and the East Kalimantan Provincial Investment Coordinating Board (BKPMD), as the defendant.
Bayan said in a statement that as its intervention request has been accepted by the court, PT OM has the same right with BKPMD to defend its interest. ?In relation to the participation of PT OM in the legal dispute, we have appointed a lawyer to defend our rights before the law,? Bayan said in the statement.
Bayan, which owns PT OM via ASX-listed Kangaroo Resources Ltd, said that the case started after the BKPMD issued a decision on May 12, 2016 reducing the 1,061-ha mining concession of PT Senyiur in Tabang District, Kutai Kartanegara Regency, East Kalimantan Province, by about 748-ha because it overlapped with the mining concession of PT OM. This has triggered PT Senyiur to file lawsuit against the BKPMD with the local state administrative court.
To help defend its interest in the court proceedings, PT OM then filed a request for intervention.
