Court ruling over Bayan coal unit concession dispute challenged

IDX-listed coal mining firm PT Bayan Resources Tbk said that a recent Jakarta High State Administrative Court (PTTUN) ruling in favor of its East Kalimantan coal unit, PT Orkida Makmur (OM), in a case against coal miner PT Senyiur Sukses Pratama has been challenged by the latter.
Bayan said in a statement on Wednesday that it has been officially informed about an appeal to the court?s ruling filed by Senyiur. The company added that it has appointed a lawyer to defend OM?s interest in the court.
Bayan indirectly owns OM through ASX-listed Kangaroo Resources Ltd.
Bayan announced on August 23 that the PTTUN has ruled in favor of OM over concession dispute with Senyiur.
Bayan said that the court has annulled an earlier Samarinda court ruling, and maintained a May 2016 decision by the East Kalimantan Regional Investment Coordinating Board (BKPMD), which reduced the 1,061-ha mining concession of Senyiur in Tabang District, Kutai Kartanegara Regency, East Kalimantan Province, by about 748-ha because it overlapped with the mining concession of PT OM. Bayan said that with the court?s ruling to maintain the BKPMD decision, the OM concession was no longer overlapping with part of Senyiur?s concession.
Senyiur had previously filed a lawsuit against BKPMD with the Samarinda court for the decision reducing the size of the company?s concession. OM then filed request for ?intervention? with the court to also defend its interest.
