The government rejected accusation of uncertainty on mining policy in the country, following the decision of Supreme Court scrapping a government ban on the export of unprocessed minerals.
A report made public on Monday said that the Supreme Court has scrapped a government restriction on the export of raw mining products.
Chairman of Investment Coordinating Board (BKPM) Chatib Basri said that the supreme court decision reflected the democracy system in Indonesia.
"I would not call this an uncertainty, it is actually reflecting the legal certainty," he said at the Indonesian Investment Summit at Rizt Carlton.
"Because the final decision will be made by the court. The government could issue a decree, if you disagree you can bring the case to the court. What I am worried about is if a decree is made by the government and later in the the day we annul the decision, this will create an uncertainty," said Chatib.
"But if the decision is annulled by the court this is a legal system that we have to follow," he said.
The Ministry of Energy and Mineral Resources Ministry has restricted export of 65 unprocessed mining products since May requiring miners to pay a-20-percent export tax ahead of total implementation of export ban on all raw mining products.
