IMA to file judicial review of Law No 4/2009

The Indonesian Mining Association (IMA) plans to file for a judicial review of Law No 4/2009 on Coal and Mineral with the Constitutional Court as certain chapters in the law have inflicted losses to miners.

?There have been serious talks with the experts toward a judicial review. We have sufficient ?ammunition? although some members (of IMA) remain reluctant,? IMA Executive Director Syahrir AB told Petromindo.com.

One example of the chapters seen as damaging to the miners is Chapter 169B, which stipulates the adaptation of the status of the holders mining contract of work (KK) to the licensing regime mandated by the law. ?If this can be revoked by the Constitutional Court, then the trouble for the KK is over,? Syahrir said.

Other chapters targeted for the review is chapter 171 on working plan, and 169C on state revenue. ?Also included is the licensing authority given to regional administration. All these we consider unconstitutional, and we?re confident to win at the Court,? he said.
