KOSEP opens tender for 50,000 tons of bituminous coal

INVITATION TO BID (ITB)
For Steaming Coal Supply

KOSEP is inviting a bid for the supply of coal from qualified suppliers on ITB (Ref. Attached file) and invites your company to submit a bid to supply coal for KOSEP Power Plants as follows,

1. Bid Notice No. : KOSEP-Coal-2008-SP02 (ITB No.)
2. Quantity: 50,000MT
- Bidders can bid up to 50,000 Metric Tons by lots of 10,000MT on both FOBT and CFR basis. (The minimum quantity of bidding is 10,000MT)
3. Shipping Schedule (Loading port): January, 2008 ~ March, 2008
4. Procurement Method: International Competitive Bidding as per ITB (Ref. the attached file)
5. Qualification: Coal producers, marketing companies or traders who attempt to supply coal of Russia or China and shall meet the whole requirements of ITB including but not limited to, coal quality specification, shipping schedule, etc. are qualified to participate in the ITB.
6. Coal Specification: Bituminous coal spec. in the ITB
7. Payment Terms
A. KOSEP shall determine the payment from either Banker?s Usance Letter of Credit (L/C) or Telegraphic Transfer (T/T) payment basis and notify it to seller.
B. In case L/C is opened, ?Adjustment of the Price for Quality? clause shall be inserted to the special conditions of L/C.

8. Terms and conditions for a new Bidder
A. Definition
A new Bidder means the bidder who does not have any coal supply record to five generation companies of KOSEP, KOMIPO, KOWEPO, KOSPO, KEWESPO in Korea or Taiwan Power or J-Power in recent three years, or the Bidder who has unfaithful records to the above seven companies.
B. Contract
The New bidder shall make a contract, in principle, only on the CFR basis, in case that it is appointed as a contractor according to bid evaluation.
C. Coal Sample
After receipt of Award Notice from KOSEP, the new Bidders have to send one coal sample (above 2kg), on KOSEP?s request, taken by an inspection agency to a power plant designated by KOSEP.
D. Determination of Coal Quality
a. Coal quality analysis at the loading port shall be provisional, and should be done by an independent inspection agency approved with a written letter by KOSEP.
b. Coal quality analysis at the unloading port by International Agency (Interttek Caleb Brett-KIMSCO Korea or SGS Korea Co., Ltd. etc) shall be final.
c. The costs required for the determination of the quantity and quality certification at the loading port and unloading port shall be borne by the Seller.
d. KOSEP has the right to perform additional quality surveillance to the coal mine and the shipping process. In such event, the Seller shall cooperate with such attendance and observation. The costs required to perform additional quality surveillance shall be borne by KOSEP.
E. Payment Terms
In case of a new bidder, KOSEP shall determine the payment with Telegraphic Transfer (T/T) payment basis only.
F. Bid Bond and Performance Bond
A new Bidder has to provide Bid Bond and Performance Bond according to Bidding Instructions? Clause 2 and 5 respectively.

9. Bid closing date: 2:00 P.M. on Friday, January 18, 2008. (Korean Standard Time)
