KTE?s boss sentenced to 15 years in KPC divestment case

In their ruling, a panel of judges comprising Djoko Sarwoko, Krisna Harahap, MS Lumme, Abdul Latif and Sri Murwahyudi, Anung were sentenced to 15 years in jail and fine of Rp 1 billion or additional 8 months in jail. He was also ordered to return Rp 800 million.
Earlier, the East Kalimantan High Court sentenced Anung six years in jail and fine of Rp 600 million or additional 6 months in jail.
Meanwhile, Judge Krina Harahap said that Apidian was sentenced to 12 years in jail and fine of Rp 1 billion or addition jail term of 8 months. Apidian was also ordered to return Rp 800 million. Previously, the Senggata district court acquitted Apidian from any charges.
The Supereme Court?s judges also ruled that money worth US$63 million which were perverted by Anung and Apidian were confiscated for the state.
The corruption case began when the provincial administration of East Kalimantan was given an opportunity to buy part of PT Kaltim Prima Coal?s shares, which would be sold as part of its divestment plan at that time. But, East Kalimantan Governor Awang Faroek, who was the regent of East Kutai at that time, was accused of annulling the rights of the provincial administration to buy the shares. The shares worth about US$63 million or Rp 576 million were sold to PT KTE, instead, on the ground that the East Kutai regency administration did not have money to buy them.
Awang, who was accused of taking part in deciding the use of Rp 576 billion cash gained from the sale during an annual shareholders meeting of PT KTE on Auguts 22, 2008 in Jakarta, has also been declared as a suspect in the case.
The money should have been transferred to the East Kutai regency. In fact, KTE invested about Rp 480 billion in Samuel Sekurities and Rp 72 billion in PT Capital Trade International, in addition to Rp 5.7 billion for consultant Dita Satari.(*)
