Lawsuit filed against Intitirta over coal mines in Jambi

IDX-listed plywood adhesive producer PT Duta Pertiwi Nusantara Tbk (DPN) announced on Wednesday that its subsidiary, PT Intitirta Primasakti, received a letter from the Central Jakarta District Court on April 11, 2014, notifying the firm about a lawsuit.

The firm did not provide details about the lawsuit.

Intitirta has been in a legal battle after the Ministry of Energy and Mineral Resources (MEMR) terminated the Contract of Work (PKP2B) on mines in Jambi. The company then filed a lawsuit to overturn the decision, and in July of 2012 won the legal battle at the Jakarta State Administrative Court.

According to the previous reports, the MEMR filed an appeal. Both sides are currently waiting for the ruling of the higher court.

According to the firm, following the termination of Intitirta?s PKP2B, the local regent issued IUP mining licenses on its tenement in Jambi to four companies, namely PT Abadi Pertiwi Loka, PT Inkalindo Manunggal, PT Jalaindo Mulia and PT Jamalindo Indah.

?Since PT Intitirta Primasakti?s license has been restored, our right to the tenement has thus been restored and the IUPs of the four companies have thus been revoked. They filed a lawsuit against the termination (of the IUPs),? DPN said in a statement Wednesday.

Duta Pertiwi has a 60 percent stake in Intitirta, with PT Ayrus Prima, a local company controlled by shipping magnate Oentoro Surya, controlling the balance. Intitirta operates a 46,000 hectare concession in Sorolangun, Batanghari regencies, Jambi and in Musi Banyuasin Regency in South Sumatra, which will be reduced to 25,000 hectares once production has started. The mine is part of the Third Generation PKP2B.
