MEMR issues new regulation on mining special permits

Minister of Energy and Mineral Resources (MEMR) has issued Minister Regulation No 32/2013 on the mechanism to issue special permit in the coal and mineral mining sector.

According to a copy of the regulation obtained by Petromindo.com Tuesday, the special permit in the coal and mineral mining sector comprises of the following:

Temporary permit to carry out transportation and sales given to the holders of coal or mineral exploration mining business permit (Exploration IUP) and coal and mineral special mining business permit (Exploration IUPK) to carry out transportation and sales of minerals and coal from stock pile to delivery point at the port or end user in one island, either within one regency/mayoralty, across regencies/mayoralties in one province, or across provinces.

Production Operation IUP to carry out sales activities given to companies engaged in the mining business. Entities which are not engaged in the mining business are entities which among others engaged in construction of road infrastructure facilities, construction of port, tunnel, civil construction, and dredging of rivers, lake and or sea.

Special Production Operation IUP for transportation and sales and Special Production Operation IUP for process and/or refining given to the following companies: business entities, cooperatives, and individuals.

The Special Production Operation IUP for transportation and sales is given to companies by the following:
a. Minister if the transportation and sales activities are made across provinces and/or nations, or the capital comes from foreign investment;
b. Governor if the transportation and sales activities are made across regencies/mayoralties within a province; or
c. Regent/Mayor if the activities are made within one regency/mayoralty.

Each company is not allowed to have more than one permit from each type of special permits in the coal and mineral mining sector issued by the Minister, governor, or regent/mayor in accordance with their respective authorities.
