Minerba issues requirements for coal export

The Directorate General of Mineral and Coal (Minerba) at the Ministry of Energy and Mineral Resources has issued a new regulation on the mechanism and requirements for coal miners and traders to obtain the necessary recommendation to become a registered exporter.

According to the copy of the regulation obtained on Thursday, the government has required that coal export can only be made by registered exporters approved by the Ministry of Trade. To obtain the registered exporter status, a recommendation letter from the Minerba is necessary.

The new Regulation No714.K/30/DJB/2014 sets a number of administrative requirements to get the recommendation letter including submitting copy of ?clean and clear? mining permits (for IUP mining permit holders) and copy of the Minister of Energy and Mineral Resources (MEMR) decree for holders of PKP2B coal mining contracts; copy of work and budget plan approved by local administrations for the IUP mining permit holders and by the MEMR for PKP2B contract holders; copy of proof of payment of non-tax obligations in the earlier period; and signed document stating willingness to pay production fee (royalty) upfront.

Once the requirements have been fulfilled, the regulation states that the Minerba will issue the recommendation letter within five working days. The recommendation letter is valid for three years, but will be subject to evaluation by the Minerba, which can recommend to the Ministry of Transportation for revocation of the registered exporter status.
