NNT: South Jakarta District Court decision rejected Pukuafu?s claims for damages

JAKARTA, November 12, 2010 ? PT Newmont Nusa Tenggara (?PTNNT?) announced that yesterday the South Jakarta District Court rejected PT Pukuafu Indah?s claims that President Director, Martiono Hadianto, in his individual capacity, acted unlawfully in his dealings with PTPI in relation to PTNNT?s arbitration with the Government that culminated in the March 2009 decision. The Court also rejected PTPI?s claims for damages.

In respect of that portion of PTPI?s claim against Martiono Hadianto in his capacity as President Director of PTNNT, the District Court instructed PTNNT to deliver certain documents pertaining to the arbitration to PTPI. The arbitration decision resulted in subsidiaries of Newmont Mining Corporation and Sumitomo Corporation, as the foreign shareholders, divesting a 24% stake in PTNNT to PT Multi Daerah Bersaing, as directed by the Government.

"While we await receipt of the written decision to understand if we must appeal any aspect of the decision, allow me to convey that we have no issue with providing PTPI the requested documents. Actually, we have attempted in the past to deliver the same documents to PTPI, but they declined to accept them," said Martiono.

"The Court?s decision for the President Director to deliver those documents did not specify any laws that have been violated. However, we are pleased that the Court did not accept PTPI?s claim for damages and found completely in my favor as to PTPI's claims against me as an individual." (end of release)
