Non-staff workers have no rights to receive bonus: Pertamina

The demand of non-staff workers of China National Offshore Oil Company (CNOOC) to receive bonus is baseless because the bonus payment at companies which operate under Production Sharing Contracts (PSCs) with Pertamina is given only to managers and staff workers, Neraca daily reported on Thursday.

Senior Manager for General Services of Pertamina?s production sharing contractors, Sidick Nitikusuma, said in Jakarta on Wednesday that the bonus payment as regulated in the existing regulation was limited only to managers and staff workers.

At least 100 non-staff workers at CNOOC (formerly known as YPF Maxus) rallied in front of the Jakarta Stock Exchange (JSX) on Monday demanding the management of the company to pay their bonus for the last three years.

Sidick acknowledged under the Management by Objective stated in the existing employment regulations, managers and staff workers at PRC companies are entitled to receive bonus if the management could reach production targets in certain periods.

"However, managers and staff workers have no rights to receive overtime payment as that given to non-staff workers," he said. Although the non-staff workers are not entitled to receive bonus payment, Pertamina hopes that the management of CNOOC could settle the difference with the workers amicably, Sidick added. (*)
