PLN: TJB:Invitation to tender for supply of the commissioning, testing and commercial operation coal

TANJUNG JATI B STEAM POWER PLANT EXPANSION (Units 3&4) (2 x 660MW)
INVITATION TO TENDER for SUPPLY OF THE COMMISSIONING, TESTING AND COMMERCIAL OPERATION COAL

PLN, represented by its internal strategic business Unit, PT PLN (PERSERO) PEMBANGKITAN TANJUNG JATI B, invites coal mining companies (?the Bidder) to participate in the tender for the supply of a total of up to four (4) million tons per annum of Medium Calorific Value bituminous coal (Indonesian Coal Index-5,800 kcal/kg)(?MCV Coal?), in two discreet and separate lot, for the purpose of commissioning and testing, (Lot A), and commercial operation, (lot B) at Tanjung Jati B Steam Power Plant Expansion located in Jepara, Central Java.

The Supply covered under this tender is more specially as follows:
1. Commissioning and testing MCV Coal (Lot A) : Bidder is requested to (?Proposed Coal?) for a minimum of 1,000,000 tons and up to 2,000,000 tons of MCV bituminous coal with an approximate calorific value on a Gross as Received basis (?CVgar), of about 5,700 kcal/kg, with a rejection limit of 5,400 kcal/kg, for delivery over a period of approximately twelve (12) months, commencing from March 2011, as the tentative delivery schedule.

2. Commercial Operation MCV Coal (Lot B) : Bidder is requested to propose a coal (?Proposed Coal?) for a minimum 800,000 tons per annum and up to 2,000,000 tons per annum of MCV bituminous coal with an approximate calorific value on a Gross as Received basis (?CVgar?), of about 5,700 kcal/kg with a rejection limit of 5,400 cal/kg, for a delivery over a minimum period of live(5) years, and up to tem(10) years, commencing from August 2011, as the tentative delivery schedule.

Important Information :
Bidders may submit a Proposal for either Lot A or Lot B, or both, i.e. Lot A as well as lot B, however, Bidders are reminded that :

(a) the total requirement for lot A is Two (2) million tons and/or for lot B a minimum of eight hundred thousand (800,000) to a maximum of two (2) million tons per annum may be accepted from each Bidder, over a five (5) to ten (10) years period and,

(b) each bidder shall prepare and submit any of their Proposed Coal(s) offers separately for each LOT.

2. PLN UB-TJB will select from the above Lot(s) the coal(s) on offer with the optimum quality and quantity for the Plant?s purposes, at the lowest price per kwh generated, meaning that PLN UB-TJB reserves the right to select the most economic quantity and quality from either one or both of abovementioned Lot A and/or lot B

3. In the case that the total quantity offered by the awarded Bidders proposal with the lowest evaluated price (as measured in Rupiah per kwh )within Lot A is less than the required two (2) million tons, PLN UB TJB, at it?s sole discretion, may offer to appoint the second lowest Bidder, in each lot , to supply the balance of the quantity, however at the same price as that of the lowest evaluated cost price (as measured in Rupiah per kwh), for each of the lots.

In the lot B, PLN UB-TJB at its sole discretion will decide on the final optimum quantity of between eight hundred thousand (800,000) tons up two (2) million tons per annum to be procured from any Bidder until the total required quantity four (4) million tons per year is reached through this tender.

4. Terms of Delivery: for lot A, the delivery is to be on CIF basis, delivered to Tanjung Jati B coal Unloading Point, whereas , for Lot B, the delivery is to be on the basis of FOB, at the bidder Port of Loading, )With an Bidder?s Guaranteed loading rate at Port of loading, u8sing handymax or panamax size of vessel (up to 70,000 DWT), with the further proposed option for PLN to take delivery on CIF basis, delivered to Tanjung Jati B Coal Unloading Poin.

5. Potential Bidders shall satisfy the following minimum basic criteria (the Basic Criteria)

a. The Bidder must be a coal mining company registered under the law of the Republic of Indonesia in possession of the necessary coal mining contract arrangement with or a coal mining business licenses issued by the relevant Government Authorities for the mining area, in the form of a coal Contract of work (PKP2B = Perjanjian Kerjasama Pengusahaan Pertambangan Batubara) or Mining authorization for exploration, including the authority to engage in processing, refining, transportation and marketing (KP = Kuasa Pertambangan Eksploitasi, termasuk kewenangan untuk melakukan pengolahan, pemurnian, pengangkutan dan penjualan) or a Mining Business Licenses for the operation of a coal mining company, as well as an AMDAL, approved by the relevant Government Authority as provided in Law No 4 of 2009 or as combined with any other applicable Law of Indonesia

b. The Bidder shall be able to submit proof in the form of records of actual shipments with a minimum production of 1,000,000 tons per annum, of coal with a quality (i) similar to their Proposed Coal, and (ii) of a quality within all of the reject limits and (iii)with the other characteristics as defined and specified in detail in the PLN UB-TJB?s Request for Proposal (?RFP)

c. The Bidders SHALL OFFER the proposed Coal Which shall not be supplied from a not yet producing (future) mine(s), and if so proposed, may be disqualified, at PLN /s sole discretion.

d. The CVgar of the Proposed Coal, as proposed by the Bidder shall at no time be less than the reject limit of 5,400 kcal/kg.

6. Interested companies may obtain additional information, and purchase the RFP documents, at the cost of Rp 3,000,000 (Three million tons), for each lot, at the following address, from 19 October 2009 up to and including 26 October 2009, between the hours of 09.00-1500 WIST:
