Update on Churchill arbitration: ICSID agrees to RI?s request

London-listed Churchill Mining PLC said that a tribunal at the International Centre for Settlement of Investment Disputes (ICSID) has agreed to Indonesia?s request to reconsider so-called Procedural Order No 12 and to deal with issues of document authenticity as a preliminary matter.
?The decision in Procedural Order No 12 regarding bifurcation between liability and quantum remains in abeyance and will be considered if and when appropriate. The parties are invited to agree on the dates for the document inspection phase by 25 November 2014. Churchill and its lawyers at Quinn Emanuel Urquhart & Sullivan currently are assessing the appropriate course of action in light of the tribunal's decision,? Churchill said in a statement Thursday, providing update of its lawsuit against the government of Indonesia which has revoked the mining license relating to the East Kutai Coal Project in East Kalimantan, in which Churchill and its subsidiary Planet Mining Pty Ltd held a 75 percent stake.
ICSID on October 30 turned down a request from the Indonesia?s application for a separate hearing on its fraud and document forgery allegations against Churchill as stated in its Procedural Order No 12.
