Wacik issues regulation on mining business supervision

Energy and Mineral Resources Minister Jero Wacik has issued a new regulation that will enable his office to supervise mining business management carried out by regional governments.
The Ministerial Regulation No.2/2013 on the supervision over mining business management conducted by provincial and regency/mayoralty administrations allows the ministry to monitor six areas, namely;
a. Stipulation of smallholder mining area (WPR); It can only be carried out following coordination with provincial government, consultation with regency/mayoralty?s council, approval from the holders of the land rights, the issuance of mapping coordinate system using the Ellipsoid World Geodetic System parameter, public announcement on the plan to determine WPR.
b. Stipulation and Granting of Mining Business License Area (WIUP) for non-metal mineral and WIUP for rocks; Approval or rejection of proposed non-metal mineral WIUP and rocks WIUP has to be made within 10 days, at the latest, after a complete proposal was received.
c. Granting of WIUP for metal mineral and WIUP for coal; Public announcement on the auction-bound WIUP determined by the minister has to be carried out at least 3 months before the auction/tender.
d. Issuance of People Mining License (IPR); It can be valid for 5 years at the longest and can be extended; reclamation and post-mining plans have to be available; IPR can be given to individual (maximum 1 ha), society group (maximum 5 ha), and cooperative (maximum 10 ha).
e. Issuance of IUP; For non-metal mineral WIUP and rock WIUP, the issuance of Mining Business License (IUP) is valid for 1 (one) type of non-metal mineral or rock. Similar with metal mineral WIUP and coal WIUP, it is valid only for 1 (one) type of metal mineral or coal.
f. Supervision over activities carried out by IPR and IUP holders; the government will appoint Mining Inspector and Supervisor to conduct the supervision.
