Minister issues new regulation on unsolicited toll road projects

Indonesian Minister of Public Works has issued Regulation No. 2 of 2026 on Procedures for Business Entity Initiatives for Toll Road Concessions, introducing a new framework governing unsolicited toll road projects in Indonesia.
The update was highlighted in a LinkedIn post by digital legal platform Veritask, which outlined the key provisions of the new regulation.
Signed on Feb. 3, 2026, and effective from Feb. 19, 2026, the regulation sets out the mechanisms, requirements and rights of business entities acting as initiators in the construction and operation of toll roads.

Under the new rule, private companies, state-owned enterprises (SOEs), regionally owned enterprises (BUMDs) and cooperatives may propose toll road projects through an unsolicited scheme, subject to specific administrative, technical and financial requirements.
The regulation serves as the implementing provision of Article 30 paragraph (9) of Government Regulation No. 23 of 2024 on Toll Roads by detailing the procedures for business entity initiatives in toll road concessions. It also governs initiative transition mechanisms and outlines the technical and financial requirements that must be fulfilled in project submissions, providing greater legal certainty for toll road development.
