Regulation: Presidential Instruction on Forestry Moratorium

NUMBER 10 YEAR 2011
REGARDING
THE POSTPONEMENT OF THE ISSUANCE OF NEW LICENSE AND PERFECTION OF PRIMARY NATURAL FOREST AND PEAT LAND MANAGEMENT SYSTEM
THE PRESIDENT OF THE REPUBLIC OF INDONESIA
In the framework of balancing and harmonizing economic, social, cultural and environmental development as well as in a bid to lower green house emission through the reduction of emission resulting from deforestation and forest degradation, we herewith instruct:
1. The Minister of Forestry;
2. The Minister of Home Affairs;
3. The Minister of Environmental Affairs;
4. The Head of the President Working Unit for Development Supervision and Controlling;
5. The Head of the National Land Affairs Agency;
6. The Chairman of the National Spatial Management Coordinating Board;
7. The Chairman of the National Survey and Mapping Coordinating Board;
8. The Chairman of the Task Force for Preparing the Establishment of REDD+ Institution or Chairman of institution established to execute special tasks in the field of REDD+;
9. Governors;
10. Regents/Mayors;
To observe the following provisions:
FIRST: Taking necessary measures by virtue of their respective tasks, functions and authority to support the postponement of the issuance of new license to primary natural forest and peat land located in conservation forest, protected forest, production forest (limited production forest, ordinary/permanent production forest, convertible production forest) and areas destined to other purposes, as contained in Indicative Map of the Postponement of New License, which becomes attachment to the presidential instruction.
SECOND: The postponement of the issuance of new license as meant in Dictum FIRST shall apply to the use of area of primary natural forest and peat land with the exception granted to:
a. The applications already securing principal approval from the Minister of Forestry;
b. The implementation of vital national development, namely geothermal, oil and natural gas, electricity, land for paddy and cane;
c. The extension of the existing licenses to utilize forest and/or use forest areas as long as the licenses in the business lines remain effective; and
d. Ecosystem restoration.
THIRD: Special Instruction to:
1. The Minister of Forestry:
a. Delaying the issuance of new license to primary natural forest and peat land in conservation forest, protected forest, production forest (limited production forest, ordinary/permanent production forest, convertible production forest) on the basis of the Indicative Map of the Postponement of New License.
b. Improving policy on management system of leasehold license and business license to utilize timber forest products in natural forest.
c. Enhancing effectiveness in the management of critical land by observing policies on proper forest and peat land management system through, among others, ecosystem restoration.
d. Revising the indicative map of the postponement of new license in forest area every 6 (six) months.
e. Stipulating the indicative map of the postponement of new license of primary natural forest and peat land in forest area, which has been revised.
2. The Minister of Environmental Affairs:
Taking measures to reduce emission of forest and peat land through the improvement of management system in the recommended business activities in forest and peat land stipulated in the indicative map of the postponement of new license through environmental license.
3. The Minister of Home Affairs:
Fostering and supervising governors and regents/mayors in the implementation of this presidential instruction
4. The Head of the National Land Affairs Agency:
Delaying the issuance of land titles, among others, right to use land for business purpose, right to use land in area designated to other purposes on the basis of the indicative map of the postponement of new license.
5. The Chairman of the National Spatial Management Coordinating Board:
Expediting the consolidation of the indicative map of the postponement of new license into the revision of spatial management map as part of the improvement of procedures for managing the use of land through cooperation with governors, regents/mayors and the Chairman of the Task Force for Preparing the Establishment of REDD+ Institution or Chairman of institution established to execute special tasks in the field of REDD+.
6. The Head of the National Survey and Mapping Coordinating Board:
Renewing map of forest cover and peat land in accordance with the indicative of the postponement of new license in forest area and area designated to other purposes every 6 (six) months through cooperation with the Minister of Forestry, Head of the National Land Affairs Agency and the Chairman of the Task Force for Preparing the Establishment of REDD+ Institution or Chairman of institution established to execute special tasks in the field of REDD+.
7. Governors:
Delaying the issuance of recommendation and new site permits in forest area and peat land as well as area designated to other purposes on the basis of the indicative map of the postponement of new license
8. Regents/Mayors:
Delaying the issuance of recommendation and new site permits in forest area and peat land as well as area designated to other purposes on the basis of the indicative map of the postponement of new license
FOURTH: The indicative map of the postponement of new license in area designated to other purposes, which constitutes a result of the renewal as meant in Dictum THIRD point 6 shall be stipulated in the Minister of Forestry.
FIFTH: The issuance of new license, recommendation and site permit as meant in Dictum THIRD shall be delayed for 2 (two) years as from the date of the issuance of the presidential instruction.
SIXTH: The implementation of this presidential instruction shall be reported by the Minister of Forestry to the President every 6 (six) months or at any time if necessary.
SEVENTH: The Head of the President Working Unit for Development Supervision and Controlling and/or the Chairman of the Task Force for Preparing the Establishment of REDD+ Institution or Chairman of institution established to execute special tasks in the field of REDD+ shall monitor the implementation of this presidential instruction and report the results thereof to the President.
EIGHTH: Implementing this presidential instruction with a full sense of responsibility

The presidential instruction shall come into force as from the date of issuance.
